Federal Judge Orders Release of Kilmar Abrego Garcia from ICE Custody
A federal judge has ruled the prompt discharge of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement lacks lawful basis.
"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her ruling.
The situation originates in a erroneous removal to El Salvador earlier this year, which the government later acknowledged was an error. After his return to the United States to face human smuggling allegations, he was detained in federal custody.
In her order, the judge noted that the government does not have a current removal order, which prevents them from removing Mr. Abrego Garcia "at this juncture."
